PRIVACY NOTICE / CLARIFICATION TEXT UNDER THE TURKISH PERSONAL DATA PROTECTION LAW

Prepared for data subjects located in Türkiye under Law No. 6698 on the Protection of Personal Data.

2. SCOPE OF THIS PRIVACY NOTICE / CLARIFICATION TEXT

This Privacy Notice / Clarification Text relates to personal data processed by Blanco Mümessillik Tekstil ve Dış Ticaret Limited Şirketi within the scope of the website www.shopeternalsage.com, membership, order, payment, delivery, return, customer services, marketing permissions and website usage processes.

3. CATEGORIES OF PERSONAL DATA PROCESSED

Identity and contact data: name, surname, telephone number, e-mail address, delivery/billing address, customer number and order number.

Customer transaction data: order, product, size, color, price, payment status, invoice, delivery, cargo/shipping, return/exchange, request and complaint records.

Financial transaction data: payment method, payment authorization/provision information, invoice information and refund information.

Full credit card details are not stored by the Seller; payment transactions are carried out through authorized payment institutions.

Digital transaction and transaction security data: IP address, device information, browser information, cookie identifiers, website usage activities, log records and date-time information.

Marketing data: commercial electronic communication consent, communication preferences, newsletter subscription, campaign interests, shopping preferences, favorite products and cart information.

Communication and customer service data: e-mail correspondence, call/message contents, request and complaint descriptions.

4. PURPOSES OF PROCESSING PERSONAL DATA

Personal data are processed for the purposes of creating and managing memberships, receiving orders, establishing and performing the sales agreement, carrying out payment transactions, issuing invoices, delivering products, conducting cargo and shipping processes, finalizing return/exchange requests, responding to customer service requests, improving products and services, ensuring information security, fulfilling legal obligations, resolving disputes and, where explicit consent/approval is available, carrying out campaign, promotional and marketing activities.

5. METHOD AND LEGAL BASIS FOR COLLECTING PERSONAL DATA

Personal data are collected through the website, membership and order forms, payment infrastructure, cargo and logistics processes, e-mail, telephone, customer service channels, cookies, social media interactions and electronic recording systems, by automated or partially automated means.

Personal data are processed on the legal grounds set forth under Article 5/2 of the Turkish Personal Data Protection Law No. 6698, including the establishment or performance of a contract, compliance with the data controller’s legal obligations, establishment, exercise or protection of a right, and the legitimate interests of the data controller provided that the fundamental rights and freedoms of the data subject are not prejudiced.

For marketing and commercial electronic communication processes, personal data are processed where explicit consent/approval is obtained.

6. TRANSFER OF PERSONAL DATA

Personal data may be shared with payment institutions, banks, cargo/logistics companies, e-commerce infrastructure providers, software and hosting service providers, accounting and financial advisory service providers, legal advisors, auditors, suppliers, authorized public institutions and organizations, courts and enforcement offices, limited to the processing purpose and to the extent necessary.

Where international delivery, foreign infrastructure/hosting/software services or global payment/analytics services are used, personal data may be transferred abroad in accordance with the transfer conditions prescribed under the Turkish Personal Data Protection Law.

The Seller is responsible for establishing the necessary legal mechanisms in this regard.

7. COOKIES AND AUTOMATED TECHNOLOGIES

Necessary, performance, analytical, functional and marketing cookies may be used on the website.

Details regarding cookies are set out in the Cookie Policy.

User preferences should be obtained where required for cookies other than strictly necessary cookies.

8. RIGHTS OF THE DATA SUBJECT

Under Article 11 of the Turkish Personal Data Protection Law, data subjects have the right to learn whether their personal data are being processed; request information if their personal data have been processed; learn the purpose of processing and whether the data are used in accordance with such purpose; know the third parties to whom personal data are transferred domestically or abroad; request correction if personal data are incomplete or inaccurate; request deletion or destruction within the conditions prescribed by law; request notification of correction/deletion/destruction operations to third parties to whom the data have been transferred; object to any result arising against them through analysis exclusively by automated systems; and claim compensation if they suffer damage due to unlawful processing of personal data.

9. APPLICATION METHOD

Data subjects may submit their requests under the Turkish Personal Data Protection Law to the Seller’s address specified above in writing, together with information/documents verifying their identity, or may send such requests to customercare@shopeternalsage.com.

Applications shall be evaluated within the periods prescribed under the applicable legislation.

10. RETENTION PERIOD

Personal data are retained for the period required by the purposes of processing and for the limitation/retention periods prescribed under the applicable legislation.

Upon expiry of such period or where the reason for processing ceases to exist, personal data shall be deleted, destroyed or anonymized in accordance with the applicable legislation.

11. UPDATES

The Seller may update this Privacy Notice / Clarification Text due to changes in legislation, business processes or website infrastructure.

The current version shall be published on www.shopeternalsage.com.

Bu Aydınlatma Metni, Blanco Mümessillik Tekstil ve Dış Ticaret Limited Şirketi tarafından işletilen www.shopeternalsage.com internet sitesi, üyelik, sipariş, ödeme, teslimat, iade, müşteri hizmetleri, pazarlama izinleri ve site kullanımı süreçlerinde işlenen kişisel verilere ilişkindir.

Müşteri işlem verileri: sipariş, ürün, beden, renk, fiyat, ödeme durumu, fatura, teslimat, kargo, iade/değişim, talep ve şikayet kayıtları.

Finansal işlem verileri: ödeme yöntemi, ödeme provizyon bilgisi, fatura bilgisi, iade bilgisi.

Kredi kartı bilgilerinin tamamı Satıcı tarafından saklanmaz; ödeme işlemleri yetkili ödeme kuruluşları üzerinden yürütülür.

Dijital işlem ve işlem güvenliği verileri: IP adresi, cihaz bilgisi, tarayıcı bilgisi, çerez tanımlayıcıları, site kullanım hareketleri, log kayıtları, tarih-saat bilgisi.

Pazarlama verileri: ticari elektronik ileti izni, ileti tercihleri, bülten aboneliği, kampanya ilgisi, alışveriş tercihleri, favori ürünler ve sepet bilgileri.

İletişim ve müşteri hizmetleri verileri: e-posta yazışmaları, çağrı/mesaj içerikleri, talep ve şikayet açıklamaları.

4. KİŞİSEL VERİLERİN İŞLENME AMAÇLARI

Kişisel veriler; üyelik oluşturulması ve yönetilmesi, sipariş alınması, satış sözleşmesinin kurulması ve ifası, ödeme işlemlerinin yürütülmesi, fatura düzenlenmesi, ürünlerin teslim edilmesi, kargo süreçlerinin yürütülmesi, iade/değişim taleplerinin sonuçlandırılması, müşteri hizmetleri taleplerinin yanıtlanması, ürün ve hizmetlerin geliştirilmesi, bilgi güvenliğinin sağlanması, hukuki yükümlülüklerin yerine getirilmesi, uyuşmazlıkların çözümü ve açık rıza/onay bulunması halinde kampanya, tanıtım ve pazarlama faaliyetlerinin yürütülmesi amaçlarıyla işlenir.

5. KİŞİSEL VERİ TOPLAMANIN YÖNTEMİ VE HUKUKİ SEBEBİ

Kişisel veriler; internet sitesi, üyelik ve sipariş formları, ödeme altyapısı, kargo ve lojistik süreçleri, e-posta, telefon, müşteri hizmetleri kanalları, çerezler, sosyal medya etkileşimleri ve elektronik kayıt sistemleri aracılığıyla otomatik veya kısmen otomatik yollarla toplanır.

Kişisel veriler, KVKK m.5/2 kapsamında sözleşmenin kurulması veya ifası, veri sorumlusunun hukuki yükümlülüğünü yerine getirmesi, bir hakkın tesisi/kullanılması/korunması, ilgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla veri sorumlusunun meşru menfaati hukuki sebeplerine dayanılarak; pazarlama ve ticari elektronik ileti süreçlerinde ise açık rıza/onay bulunması halinde işlenir.

6. KİŞİSEL VERİLERİN AKTARILMASI

Kişisel veriler; ödeme kuruluşları, bankalar, kargo/lojistik firmaları, e-ticaret altyapı sağlayıcıları, yazılım ve barındırma hizmet sağlayıcıları, muhasebe ve mali müşavirlik hizmet sağlayıcıları, hukuk danışmanları, denetçiler, tedarikçiler, yetkili kamu kurum ve kuruluşları ile mahkemeler/icra daireleriyle, işleme amacıyla sınırlı ve gerekli olduğu ölçüde paylaşılabilir.

Yurt dışı teslimat, yabancı altyapı/hosting/yazılım hizmeti veya global ödeme/analitik hizmetleri kullanılması halinde kişisel veriler, KVKK’da öngörülen aktarım şartlarına uygun şekilde yurt dışına aktarılabilir. Bu konuda gerekli hukuki mekanizmaların oluşturulması Satıcı’nın sorumluluğundadır.

7. ÇEREZLER VE OTOMATİK TEKNOLOJİLER

İnternet sitesinde zorunlu, performans, analitik, işlevsel ve pazarlama çerezleri kullanılabilir.

Çerezlere ilişkin ayrıntılar Çerez Politikası’nda yer alır.

Zorunlu çerezler dışında kalan çerezler için gerektiğinde kullanıcı tercihleri alınmalıdır.

8. İLGİLİ KİŞİNİN HAKLARI

İlgili kişiler KVKK m.11 kapsamında; kişisel verilerinin işlenip işlenmediğini öğrenme, işlenmişse buna ilişkin bilgi talep etme, işleme amacını ve amaca uygun kullanılıp kullanılmadığını öğrenme, yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilme, eksik/yanlış işlenmişse düzeltilmesini isteme, mevzuat şartları dahilinde silinmesini veya yok edilmesini isteme, düzeltme/silme/yok etme işlemlerinin aktarılan üçüncü kişilere bildirilmesini isteme, otomatik sistemler yoluyla aleyhe sonuç doğmasına itiraz etme ve hukuka aykırı işleme nedeniyle zarara uğraması halinde zararın giderilmesini talep etme haklarına sahiptir.

9. BAŞVURU YÖNTEMİ

İlgili kişiler, KVKK kapsamındaki taleplerini kimliklerini tevsik edici bilgi/belgelerle birlikte Satıcı’nın yukarıda belirtilen adresine yazılı olarak veya customercare@shopeternalsage.com adresine iletebilir.

Başvurular mevzuatta öngörülen sürelerde değerlendirilir.

10. SAKLAMA SÜRESİ

Kişisel veriler, işleme amaçlarının gerektirdiği süre ve ilgili mevzuatta öngörülen zamanaşımı/saklama süreleri boyunca saklanır.

Sürenin sona ermesi veya işleme sebebinin ortadan kalkması halinde kişisel veriler mevzuata uygun olarak silinir, yok edilir veya anonim hale getirilir.

11. GÜNCELLEME

Satıcı, mevzuat değişiklikleri, iş süreçleri veya internet sitesi altyapısındaki değişiklikler nedeniyle bu Aydınlatma Metni’ni güncelleyebilir.
